The Failure of the 28-Article Ceasefire Plan for Ukraine: How Peace Negotiations Continue to Stumble

Europe felt a moment of respite on Monday, as the crisis caused by the introduction of a new 28-article proposal for achieving ceasefire appeared – momentarily – to have been contained. A senior US official spoke of "substantial progress" after diplomatic discussions in Geneva. On Monday night, Russian leadership made its response: an extensive attack of aerial bombardment on Kyiv.

The Pattern of Diplomacy and Destruction

The sequence of contrasting events captured the bleak nature of the recent timeframe. By day, political struggles are conducted: hopeful statements are issued from various governments. Significant resources is allocated on restraining certain initiatives. By night, Moscow forcefully demonstrates the world that, for them, military action persists as the primary tool for achieving "peace".

Nighttime Reality

As the offensive unfolded into the early hours of Tuesday, the present situation of Ukraine's exposure was exposed. Ukraine is equipped to monitor rocket firings from across the border, a capacity afforded by up-to-date information. From observation points, Ukrainian air force fighter jets that had been deployed to engage hostile aerial threats streaked across the sky – sophisticated military planes supplied to Ukraine by Western partners.

Shortly after, Kyiv's air-defence systems thundered: several firings fired to intercept a hostile projectile. This was a sophisticated defense system at work, probably supplied through allied countries. Every firing shakes the surroundings, causing tremors. The brief panic quickly becomes resigned acknowledgment: perhaps the incoming missile won't hit its mark this time, protecting urban areas from devastation and further power outages.

Ongoing Risks

Not long after, a heavy machine gun opened up on a drone somewhere nearby, part of a mobile-fire group – most likely imported technology. Regrettably, the shots failed to hit the opposing UAV – it pressed on overhead toward its objective.

Intermittently, this persisted until dawn. Kyiv faced the early updates: seven people killed, destruction and infrastructure problems in multiple buildings as a result of the evening attack. As typically, everyone still maintained normal activities – living the war. But those entire period encapsulated Ukraine's essential dependence on Western support – a dependence that European nations are demonstrably unable to fill in the near term.

Ineffective Peace Efforts

The detailed framework from US administration sparked intense emotion, debate and profound anxiety – and temporarily diverted attention from Ukraine's most significant graft case in years. Yet, we have experienced comparable situations, after earlier high-level meetings and bilateral conferences.

Every new proposal from Washington unfolds according to the identical sequence: a political offensive against Ukraine, which Kyiv, with allied governments, manages to fend off. They contain the crisis but never actually achieve victory. This trend will, no doubt, continue.

Tactical Assessments

It is convenient to criticize specific actors of consistently pushing Russian terms. But that does not seem to be the complete picture. US administration functions according to a principle familiar among seasoned negotiators: you cannot achieve through diplomacy what you have been unable to protect through force. The White House presumes that it is unfeasible to pressure the Kremlin to surrender the areas that it currently occupies in Ukraine's southern or eastern regions.

The issue is that while recognising this factual reality, US leadership does little to prevent Kremlin actions, through statements or actions, from assuming that the current condition will not change more in its advantage in the months ahead.

Opposing Positions

Therefore, Russian leadership is confident that the clock favors them – that Ukraine and its partners are nearing depletion. Their incentive to sign a deal that does not give them the maximum possible gain is almost completely absent. There may be many attempts to stop fighting, but they will carry on as long as Russia's leadership remains supremely confident in the result.

On the contrary, Ukraine's government believes that Ukraine can still endure, slowly losing civilians and areas but preventing a total frontline collapse until circumstances change in its benefit.

Existing Situation

Objectively, there are no genuine requirements for a truce. Now, individual motivations are entering the equation: personal goals to negotiate peace and secure international recognition, and Ukrainian leadership's twin challenges – on one hand, not to alienate a key ally, and on the other, to rally Ukrainians around the country's interests against any plan Kyiv finds unworkable, so that their focus does not move to domestic problems. And although their objective will now be much harder after current events, it remains very improbable that this will alter their fundamental strategy.

These two forces are influencing discussions.

Assessment and Future

It took a mere seven days to kill the suggested clauses of the current initiative. Forceful and unpredictable management of the matter by US administration, pushback by Ukraine and the rest of Europe, along with calming attempts of diplomats, and finally, latest revelations, all achieved their purpose.

While new plans based on previous concepts are imminent, Kyiv, London and other European capitals should reach an essential realization: Ukraine and Europe will only be able to counter diplomatic offensives from Washington that are founded on Moscow's terms and show certain reluctance to modify developments, if they remain united and strengthen their defence capabilities at a much faster pace. If they do, no combination of diplomatic or military actions will be able to overcome them. In the meantime, Ukraine's capability to repel nightly air assaults will, for the coming months, primarily depend on sustained allied backing.
